CHOOSING AN ELECTION INSPECTOR IN THE ERA OF ELECTRONIC VOTING
As Inspectors of Elections, NLB Consulting will:
- Determine if the Association has new Election Rules in place that conform to SB 323 and AB 2159 (if applicable)
- Determine the number of memberships entitled to vote and the voting power of each
- Determine if the Association is eligible for Election by Acclamation
- Determine the authenticity, validity, and effect of proxies if any
- Receive ballots
- Ensure compliance with all of the following, if conducing an election by electronic secret ballot
- Provide each member voting by electronic secret ballot all of the following:
- A method to authenticate the member’s identity to the internet-based voting system
- A method to transmit an electronic secret ballot to the internet-based voting system that ensures the secrecy and integrity of each ballot
- A method to confirm, at least 30 days before the voting deadline, that the member’s electronic device can successfully communicate with the internet-based voting system
- Provide an internet-based voting system that shall have the ability to accomplish all of the following:
- Authenticate the member’s identity
- Transmit a receipt to each member who casts an electronic secret ballot
- Permanently separate any authenticating or identifying information from the secret ballot, rendering it impossible to connect and election ballot to a specific member
- Store and keep electronic secret ballots accessible for recount, inspection and review purposes
- Provide each member voting by electronic secret ballot all of the following:
- Hear and determine all challenges and questions in any way arising out of or in connection with the right to vote.
- Determine when polls shall close, consistent with the governing documents
- Determine the tabulated results of the election.
- Perform any acts as may be proper to conduct the election with fairness to all members in accordance with California Civil Code the Corporations Code, and all applicable rules of the association regarding the conduct of the election that are not in conflict with Civil Code requirements.
- Open, count and tabulate all ballots at a duly noticed open meeting after the cessation of voting.
- Prepare a formal election report for distribution to all members.
- Retain all applicable election materials until after the challenge period.
